These terms and conditions are in reference to the www.harperbee.com.au website, and are in effect as of July 20, 2017. Please refer to our privacy policy for more information.

These terms dictate the appropriate use of the www.harperbee.com.au website and the shop feature contained therein. They exempt Harper Bee and other persons from liability or limit their liability, and contain other relevant provisions.

These terms are an agreement between you and the Australian business Harper Bee Pty Ltd (as the trustee of Burfords in Oz Trust ABN 59 978 162 867). They dictate your access to and your use of the www.harperbee.com.au website. When you use our website you agree to these terms. If you do not agree to these terms, you may not use our website.

These terms may be changed occasionally by approved editors. You will be alerted if the terms are changed and in using the website agree to these new terms.

 

Your use of the website

The website, including content, products, images, graphics, and other intellectual property, is the property of Harper Bee and/or others, and is protected by copyright, trademark and other laws. Your use of the website does not transfer you ownership of any of the content. The website may not be used for unlawful or commercial purposes, it is for lawful, personal use only. You may use the website only as permitted in these terms. The website and its content may not be copied, distributed or modified in any way without the permission of Harper Bee. You may use the website if you are an Australian resident, however you may not purchase items from the store unless you are over 15 and can form a legally binding contract, or you are assisted by a parent or guardian. Currently, Harper Bee only ships from our website to addresses within Australia.

 

The Buzz

Certain features of the website are only available to members of the loyalty program, The Buzz. If you have been issued with a username and password, you should not disclose this information to any other person. You are responsible and liable for your login information. If you believe your login information has been stolen or lost, please contact Harper Bee at hello@harperbee.com.au or call us on 07 3063 1045. Accuracy of information

All information provided from you to Harper Bee via this website, including payment information, The Buzz membership details, and transaction information, must be true, accurate and complete. You will be solely responsible and liable for all loss, damage, and additional costs that may incur as a result of you providing false, incorrect or incomplete information.

Harper Bee, the Harper Bee logo and other names and logos used on our website are registered or unregistered trademarks, service marks, trade names and logos owned or licensed by Harper Bee or their respective owners or licensees. Any use of these trademarks (other than permitted by Harper Bee) is prohibited.

This site may contain errors, faults and inaccuracies and may not be complete and current. Harper Bee makes no representations or warranties of any kind, except as provided under applicable laws. Harper Bee cannot guarantee that any file contained within this website is free from viruses. You assume all risk of all programs and files on this site, and you release Harper Bee entirely of all responsibility for any consequences of its use.

Dispute resolution

These terms, your access to and use of this website, and all related matters are governed solely by the laws of Queensland, Australia and applicable federal laws of Australia. Any dispute between you and Harper Bee or any other person arising from, connected with or relating to the website, these terms or any related matters will be resolved before the Courts of Queensland, sitting in Brisbane, and you hereby irrevocably submit and attorn to the original and exclusive jurisdiction of the courts in respect to all disputes.

These terms and conditions are part of the terms and conditions of use of the Harper Bee website.

 

Shipping

If the product you have purchased is in stock, the Harper Bee team will email you with a shipping and payment notice. You will be alerted when your items have been shipped and are on their way to you, and you will also be notified that your credit card has been charged or your other method of payment has been accepted.

If your item is in stock it will usually ship within 3 business days of you placing your order. If the item is not in stock when the order is placed, we will ship your order when it returns to stock. We will notify you at this time.

Harper Bee uses Australia Post to ship our items, and you may choose your shipping type – standard or express – when you check out. These shipping types will have different charges corresponding to how fast you want your item to reach you.

 

Acceptance of Orders

Harper Bee may limit item quantities available for sale, and we reserve the right at any time to reject, correct, cancel or terminate any order at our discretion. If the price of any product in your order was incorrectly displayed on our website, we will remove it from your current order and provide you the opportunity to reorder it at the correct price, assuming the product is available.

Your correctly completed and submitted order information does not constitute an accepted order. Your order is accepted if and when we send an acceptance and shipping notification to your specified email address. That email forms a legally binding contract between you, the purchaser, and Harper Bee Pty Ltd, which operates at www.harperbee.com.au. You will be charged for your items when this email notice is sent.

Orders that cannot be filled at the same time will be treated as separate orders. If an order cannot be filled because the product is not available for shipment, our customer service team will contact you and you will be given the option to change, cancel the order or wait for the missing stock to become available for shipment.

If an order is placed outside of Australia or is placed with a billing address outside of Australia, even if the delivery address is located in Australia, we will consider this an overseas transaction. We retain the right to either approve or deny any overseas transaction at our discretion.

 

Cancellations

If you wish to cancel an order, you may request a cancellation by calling 07 3063 1045 or emailing us at hello@harperbee.com.au. However, if you do not contact us before we accept and ship your order, this cancellation request will be ineffective. In this case, please refer to our returns policy.

 

Store Pickup

Store pickup is only available for select products and from selected locations. Please call 07 3063 1045 or email hello@harperbee.com.au to discuss store pickup for any item.

 

Methods of Payment

You can pay for any purchase you make using your Mastercard or VISA (we do not currently accept AMEX or Diners Club cards), provided it was issued in Australia. We also accept PayPal.

 

Consumer Guarantees

If you believe an item is faulty, you have the right to remedy this under Australian consumer law. You may also have simply changed your mind about your item. In both these situations, please refer to our Returns policy.

1. Introduction

1.1.  The Buzz Loyalty Program (‘the Program’) is operated by Harper Bee Pty Ltd ABN 59 978 162 867
1.2. By joining The Buzz Loyalty Program you agree to be bound by Terms and Conditions as laid out below.
1.3. Employees of Harper Bee Pty Ltd are not eligible to participate in the Program.

 

2. Membership

2.1.  The Buzz memberships are open to individuals with an Australian residential address and valid email address.
2.2.  Harper Bee reserves the discretion to accept or reject any application.
2.3.  All Members will be assigned a Membership number. This number will be used for identification purposes.

 

3. Transactions

3.1 Customers participating in the Program can obtain rewards by making purchases at participating Harper Bee stores or Harper Bee online, and can redeem such awards at participating stores and online
3.2 For a discount to apply, a valid The Buzz card must be presented at the time of the transaction or entered into the space allocated on the payment page of the Harper Bee website.
3.3 Discounts do not apply to the purchase of Harper Bee gift cards. Discounts will apply when redeeming The Buzz loyalty cards.
3.4. Discounts, offers or vouchers issued to The Buzz members are not transferrable and cannot be redeemed for cash.

 

3.1. Benefits

3.1.1 Customers using their Buzz membership are eligible to receive certain awards that are represented as “Buzz Dollars”.
3.1.2 Buzz Dollars are loaded onto the member’s loyalty card. For every $10 spent at Harper Bee, one Buzz Dollar is added to the membership card. Each Buzz Dollar is worth $1 that may be spent in the Harper Bee store.
3.1.3 Buzz Dollars can also be applied to a membership card with the discretion of Harper Bee employees.
3.1.4 Other benefits of the Buzz Loyalty program include: product sneak-peeks, occasional special pricing, a monthly newsletter, and involvement in product design and development and fundraising programs.

 

4. Cards

4.1. The Buzz loyalty card is not transferrable and may only be used by the registered member
4.2 The Buzz loyalty card is issued by and remains the property of Harper Bee Pty Ltd and is not transferable or redeemable for cash.

 

5. Personal Details

5.1 By providing your email address, you consent to receiving exclusive The Buzz offers in your inbox.
5.2 Information provided by you and information about transactions will be retained by Harper Bee.
5.3 By joining The Buzz loyalty program you agree to the collection, use and disclosure of your personal information in accordance with the Privacy Policy.
5.4 It is the responsibility of the member to keep their personal details updated and correct. You can update your details in store. If Harper Bee is not notified about a change of personal details, we may not be able to provide the full benefits of the program.

 

6. Membership Expiry or Cancellation

6.1. Membership is valid for two years from the date of joining and will need to be renewed after this period.
6.2. Members may cancel or renew their membership at any time by visiting a Harper Bee store or contacting the Harper Bee staff at hello@harperbee.com.au.

 

7. Changes to the Program

7.1. Harper Bee reserves the right to modify the terms of or withdraw The Buzz loyalty program at any time without prior notice.

 

8. Lost, damaged or stolen cards

8.1. If The Buzz loyalty card is lost, stolen or damaged, the Harper Bee team may issue a replacement card. Visit a Harper Bee store or contact the Harper Bee staff at hello@harperbee.com.au regarding lost cards.
